Re: Support for SB 1033 — Heavy metal testing and transparency for protein products

Dear Chair and Members,

My name is Oliver Amdrup-Chamby, CEO and founder of Puori, a health and nutrition company founded in 2009. I am writing in support of SB 1033 and its commonsense focus on consumer safety and transparency in the protein product category.

Transparency is urgently needed. Over the past several years, multiple independent studies and investigations have documented that an alarming share of protein powders and similar products test above California Proposition 65 thresholds for heavy metals, such as lead. Protein products are often consumed daily and over long periods of time, so even low-level contamination can translate into problematic exposure. Consumers deserve clear, consistent information and safeguards that reflect how these products are used and allow a conscious choice.

Accountability is particularly important in this category because consumers buy protein products, expecting them to be healthy. These products are used by athletes, families, and health-conscious individuals who reasonably assume that “better-for-you” also means safe. When contamination is discovered, the burden should not fall on consumers to interpret incomplete information or guess whether a company tests properly. SB 1033 appropriately places responsibility on manufacturers and brand owners to verify safety and disclose the results.

Puori’s experience shows that the bill’s expectations are achievable. Since 2009, we have tested every production batch of our products through independent third-party laboratories. Since 2018 through the Clean Label Project. Today, each batch is screened for more than 200 contaminants, including heavy metals and not released for sales, before Clean Label Project has tested and uploaded the lab report to their website. We also make results easy to access through a QR code on the label, so consumers can see exactly what they are purchasing. This approach requires investment and operational discipline, but we have demonstrated that it is practical and scalable, even for a smaller brand.

SB 1033 establishes a clear consumer-safety baseline for protein products by requiring lot-based heavy metal testing and consistent public disclosure. These steps help catch contamination before products reach consumers, reduce avoidable long-term exposure in a category often used daily, and restore confidence that “health” products are as safe as people reasonably expect.
